Former TMII agent Michael Johnston recently heard that his case against TMII, filed with the Oregon Department of Justice Civil Enforcement Division had been administratively closed.
The case was filed in 2009 and took several months to close. Unfortunately, the end result was once again not in Mike Johnston’s favor.
The response from the Oregon DOJ is reproduced below, including forwarded responses from Ashley Holbrook of TMII. Ashley writes to the Enforcement Officer :
Hi Alicia,

We contacted the business regarding your rebuttal in an effort to resolve your complaint on an informal basis and we attached their reply for your reference.
It appears this is a case of disputed facts between yourself and Transcend Marketing Int’l Inc. We are prohibited by statute in acting as attorney for you in this matter to prove your case or seek a specific remedy for you. Oregon law prohibits the Attorney General from taking that role. We have two purposes; the first is to attempt to informally mediate consumer disputes. Most businesses cooperate when we write to them and thousands of consumers are helped in this manner. Our second purpose is to identify and eliminate the most serious threats to Oregon consumers. Members of the public, who file consumer complaints, are our “eyes and ears.” It is you who tell us where the problems are. The most serious problems usually result in many complaints. Those are the cases that get most of our attention.
You may wish to contact an attorney to discuss your legal rights and options, or, on your own, file suit with your local small claims court. It appears the appropriate venue for your complaint is either small claims court, where the judge can decide the matter and possibly hand down a money judgment which may or may not be in your favor, or an attorney. If you wish, you may obtain information about the lawyer referral service via their website at www.osbar.org or you may wish to contact them at 1-800-452-7636 and receive a $35 office consultation.
We are sorry we were not able to resolve your case for your satisfactorily. Your complaint is on public record.

Clearly, TMII are untouchable unless and until somebody takes them to court. Richi and Ashley perfectly understand how toothless the organizations – supposedly trusted to protect the public are and can sandbag any and all complaints, regardless of submitted evidence.
Thanks to Mike Johnston for keeping this site updated on his case – we wish him all the best and appreciate all his contributions to the site over the past year.
